As part of Branch's partnership with DDI/Spark, Branch (also referred to as “Sponsor” in these Rules) is giving employees a chance to receive money back to their Branch Digital Wallet. Any user in the test group who spends at least $20 at a gas station using their Branch Card (not cash withdrawals or transfers) will receive an entry to win a $50 reward.
Eligibility
To enter the DDI Spend and Get (the "Promotion") you must be a lawful permanent resident in one (1) of the fifty (50) United States or the District of Columbia (excluding Vermont, Puerto Rico and the U.S. territories and possessions) and at least the age of majority in your state of residence (nineteen (19) in Alabama, Nebraska, twenty-one (21) in Mississippi, and eighteen (18) in all other states) with an active Branch Digital Wallet. Employees of Branch Messenger Inc. (“Branch”) (and family members of employees) or Evolve Bank and Trust (“Evolve”) are not eligible. The Promotion is void in Vermont, Puerto Rico, U.S. territories and possessions, outside of the fifty (50) United States, District of Columbia and where restricted or prohibited by law. By entering, Entrants agree to be bound by these Official Rules, including all eligibility requirements and the decisions of Branch, which are final and binding.
Promotional Period
The “Promotional Period” begins on Tuesday, October 5, 2021 at 12:00 AM Central Time (“CT”) and ends on Monday, October 11, at 11:59 PM CT. Note: Central Time shall control for all purposes of this Promotion.
Acceptance of Rules/Entry Conditions & Release
Entry in the Promotion does not constitute entry into any other sweepstakes, game or contest. Each Entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Sponsor which is legally binding and final in all matters relating to this Promotion; and (b) defend, indemnify, release and hold harmless the Sponsor and their respective parent, subsidiary, and affiliated companies, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Promotion, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the " Released Parties") from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's entry, creation of an entry or submission of an entry, participation in the Promotion, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of any prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry.
Alternative Method of Entry (AMOE)
You may also enter the Sweepstakes by mail as follows. On a plain 3” x 5” index card, legibly handprint or type your first name, last name, complete address, and email address, and mail your completed 3” x 5” card to Branch: DDI Spend and Get, 8014 Olson Memorial Hwy 55, #471, Golden Valley, MN 55427. To be considered eligible in the Sweepstakes, AMOE entries must be postmarked no later than the postmark date stated in the How to Win section below. Each AMOE card received will be considered as one (1) Entry for that Entrant for the Sweepstakes Period.
How to Win
During the Promotion Period, when an Entrant makes $20 worth of purchases from the Branch Wallet (not cash withdrawals or transfers) at a filling station/gas station, the Entrants who qualify will receive $50 maximum. Branch will select winners and disburse the $50 back to winners 2-5 business days after the end of the Promotion (October 11, 2021). Entrants must meet the eligibility requirements set forth in these Official Rules in order to qualify for $50. Note: You are not a winner of any prize until you have been verified as a winner by Branch.
All qualifying purchases must be made during the Promotion Period;
Odds of Winning
The odds of winning depend upon the amount of money spent by an individual user during the Sweepstakes Period.
Prizes
$50 disbursements will be available in your Branch account by October 15, 2021 by 12:59 PM CT. For the Promotion Period, winners will receive $50 to be awarded in their Branch Digital Wallet. If Entry was through AMOE, such winner will receive the same prize amounts on a virtual Amazon gift card emailed to their entry email address. Total Approximate Retail Value ("ARV") of the prizes in total is the number of entrants multiplied by up to $50 USD for the entire Promotion Period and up to $50 USD per Entrant.
Verification of Qualification of $50
All potential recipients are subject to verification by Sponsor. Sponsor’s decisions are final and binding in all matters related to the administration, operation, selection of the winner and other matters related to the Promotion. An Entrant is not a winner of any disbursement, even if the app should so indicate, unless and until Entrant’s eligibility and the potential recipient validation has been verified and entrant has been notified that verification is complete. Sponsor will not accept screenshots or copies of screen content or other evidence of qualifying for a disbursement in lieu of its validation process. Any issued entry or potential disbursement notification that occurs after the system has failed for any reason is deemed defective, void and will not be honored.
Potential recipients will be notified via email. The Referee must have an open Branch Digital Wallet in order for the Entrant to qualify for the prize.
A prize winner may be required to complete and return an Affidavit of Eligibility, Release of Liability and Publicity Release (where permitted by law), and W-9 tax payer request for identification (collectively, the " Affidavit") by the date specified by Sponsor, or an alternate potential winner (Sweepstakes potential winner only) may be selected. In the event: (a) potential winner cannot be reached for whatever reason after a reasonable effort has been exerted or the potential winner notification or Affidavit is returned as undeliverable; (b) potential winner declines or cannot accept, receive or use the prize for any reason; (c) of noncompliance with the above or within any of the aforesaid time periods; (d) potential winner is found to be ineligible to enter the Sweepstakes; (e) potential winner cannot or does not comply with the Official Rules; or (f) potential winner fails to fulfill the Affidavit-related obligations, the potential winner shall be disqualified, and the Sweepstakes prize will remain unawarded or in the case of the Sweepstakes winner, an alternate winner will be selected from all remaining eligible entries received.
Publicity
Except where prohibited or restricted by law, recipients acceptance of any disbursement constitutes the winner's irrevocable consent to the Released Parties, and each of their respective agents, successor, and assigns or other designee's use of each winner's name, likeness, photograph, voice, statement, opinions, biographical information, prize and/or state/city of residence for advertising and promotional and publicity purposes in any and all media or format, worldwide, in perpetuity, without any permission, notification, payment or consideration except for the awarding of the prizes to the winners. You may be required to sign a document confirming your consent.
General Conditions
Sponsor may cancel or modify the Promotion or eligibility or these Official Rules if fraud, technical failures or any other factor beyond its control or for any reason, impairs the integrity of the Promotion, as determined by the Sponsor in its absolute and sole discretion. In such event, all future Promotions and resulting disbursements will become void and not awarded. Sponsor's failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision.The Released Parties shall not have any obligation or responsibility, including any responsibility to award any prize to Entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Official Rules; (b) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) Customers who have committed fraud or deception in entering or participating in the Sweepstakes or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, epidemic, pandemic, terrorism, weather or any other similar event beyond Sponsor's reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this or any promotion or awared-related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (a)tampering with the entry process or the operation of the Promotion, or with any Website promoting the Promotion; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Promotion multiple times through the use of multiple email addresses or the use of any robotic or automated devices. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Promotion, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Promotion, including the entire Promotion, and/or modify the SPromotion and/or award the disbursement from all eligible entrants received as of the termination date.
Limitation of Liability
The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process for the Promotion; (d) technical or human error in the administration of the Promotion; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any disbursement.

By participating in the Promotion, Entrants hereby agree to Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted the Sponsor's privacy policy. Entrant agrees they are supplying information to the Sponsor.
Disputes
Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prizes awarded, shall be resolved by the appropriate Minnesota State Court located in the state of Minnesota; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys' fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules (whether of the State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
