ELIGIBILITY: To enter the Sweepstakes, you must be a lawful permanent resident in one (1) of the fifty (50) United States or the District of Columbia (excluding Vermont, Puerto Rico and the U.S. territories and possessions) and at least the age of majority in your state of residence (nineteen (19) in Alabama, Nebraska, twenty-one (21) in Mississippi, and eighteen (18) in all other states) with a valid Social Security number at the time of entry. Employees of Branch Messenger Inc. (“Branch”) (and family members of employees) or Evolve Bank and Trust (“Evolve”) are not eligible. Sweepstakes is void in Vermont, Puerto Rico, U.S. territories and possessions, outside of the fifty (50) United States, District of Columbia and where restricted or prohibited by law. By entering, entrants agree to be bound by these Official Rules, including all eligibility requirements and the decisions of Branch, which are final and binding.
There are two separate giveaways this holiday season. The first is the Holiday Haul Giveaway and the second is the Bonus Holiday Contest.
Please read these rules carefully to understand your eligibility and prizes.
ENTRY PERIODS: The Holiday Haul Giveaway and Bonus Holiday Contest have the same, one Entry Period, which is the entire “Sweepstakes Period,” beginning on November 15, 2021 at 10:00 AM CT and ending on December 05, 2021 at 11:59 PM CT.
HOW TO ENTER:
Holiday Haul Giveaway (“HHG”):
Eligible entrants for the Holiday Haul Giveaway (“HHG Entrants”) must have a Branch Account to enter or use the Alternative Method of Entry (AMOE) outlined below. HHG Entrants must spend at least $100 (see “Spend Amount”) on their Branch Card to be eligible to win the $1,000 deposit into their Branch Wallet, and HHG Entrants will qualify for entries (“HHG Entry”) as described below.
“Spend Amount” is determined by purchases on the Branch Card or from the Branch Digital Wallet through Google Pay or Apple Pay, once the purchase has been cleared. Transactions such as ATM withdrawals, cash back, and moving funds to an external account do not qualify towards a user’s Spend Amount. Transactions on the last day of the Sweepstakes Period will be given 3 business days to clear to be considered a part of a Spend Amount, to qualify. Spending more than the amounts needed and described below, ($100, $250 or $500) to be eligible does not increase an HHG Entrant’s chance of winning.
HHG Entrants will have an opportunity to gain additional HHG Entries through Spend Amount milestones during the Sweepstakes Period as follows:
Milestone One: HHG Entrants must spend at least $100 with their physical Branch Card or contactless payments connected to their Branch Card. Once completing Milestone One, HHG Entrants will gain ten (10) HHG Entries into the giveaway.
Milestone Two: HHG Entrants must spend at least $250 with their physical Branch Card or contactless payments connected to their Branch Card. Once completing Milestone Two, HHG Entrants will gain fifteen (15) HHG Entries into the giveaway.
Milestone Three: HHG Entrants must spend at least $500 with their physical Branch Card or contactless payments connected to their Branch Card. Once completing Milestone Three, HHG Entrants will gain twenty (20) HHG Entries into the giveaway.
During the Sweepstakes Period, there are a total of forty-five (45) HHG Entries possible per HHG Entrant, if the HHG Entrant completes all three Milestones, which are cumulative.
Bonus Holiday Contest (“BHC”):
Eligible entrants for the Bonus Holiday Contest (“BHC Entrants”) must have a Branch Account to enter or use the Alternative Method of Entry (AMOE) outlined below. BHC Entrants must have a valid, qualifying direct deposit added to their Branch Account during the Sweepstake Period.
Existing Branch users who already receive direct deposits of payroll or government benefits into their Branch Digital Wallet and who receive a qualifying direct deposit of any monetary value during the Sweepstakes Period will qualify for one (1) entry (“BHC Entry”).
For new direct deposit enrollees, because direct deposit dates (whether payroll or government benefits) may vary, BHC Entrants who sign up for direct deposit towards the end of the Sweepstakes Period will be given up to fourteen (14) additional business days after the Sweepstakes Period for the direct deposit (of any monetary value) to be added to their Branch Digital Wallet, and subsequently qualify for one (1) BHC Entry .
PLEASE NOTE: A qualifying direct deposit is dependent upon the date on which the qualifying direct deposit has been posted to the Branch Digital Wallet. In order to qualify as a BHC Entry, the eligible direct deposit must be posted to the Branch Account no later than 11:59 PM CT on December 23, 2021.

Holiday Haul Giveaway:
On December 10, 2021, Branch will randomly select one (1) potential winner from among all eligible HHG Entries received from accomplishing any one of three possible spending milestones and spending $50 during the Sweepstakes Period or through the AMOE. Potential winners must meet the eligibility requirements set forth in these Official Rules in order to qualify for a prize. Note: You are not a winner of any prize until you have been verified as a winner by Branch. Winners will be notified via email. Please note: We will never ask for your personal information or account information through social media or email, in order to deliver the prize.
Bonus Holiday Contest:
On or around December 23, 2021, Branch will randomly select five (5) potential winners from among all eligible BHC Entries received from having a direct deposit with Branch during the Sweepstakes Period or through the AMOE. Potential winners must meet the eligibility requirements set forth in these Official Rules in order to qualify for a prize. Note: You are not a winner of any prize until you have been verified as a winner by Branch. Winners will be notified via email. Please note: We will never ask for your personal information or account information through social media or email, in order to deliver the prize.

Prizes - Holiday Haul Giveaway:
One (1) Grand Prize Winner for the Sweepstakes Period will receive $1000 USD to be awarded in their Branch Digital Wallet (the "Grand Prize"). If Entry was through AMOE or the winner does not have a Branch Wallet, such winner will receive the same prize amounts on a virtual Amazon gift card emailed to their entry email address. Total Approximate Retail Value ("ARV") of the Grand Prize is $1000 USD. Notification to the winner will be delivered via email to the winner’s email associated with their Branch Account. If Entry was through AMOE and the winner does not have a Branch Account, such winner will receive the same prize amounts on a virtual Amazon gift card emailed to their entry email address.
Prizes - Bonus Holiday Contest:
Five (5) winners will each receive the following prize: If entry was through the Branch App, such winners will each receive $50 USD deposited into the winner’s Branch Digital Wallet. If Entry was through AMOE or the winner does not have a Branch Wallet, such winner will receive the same prize amount of $50 USD on a virtual Amazon gift card emailed to their entry email address.The total ARV (Approximate Retail Value) of the available prize for the Bonus Holiday Contest is $250 USD.
Additional terms regarding prizes: Only prizes specified in the amounts indicated will be awarded. Prizes are non-transferable, with no cash redemption or equivalent. Branch reserves the right to substitute a prize or prize component of equal or greater value should a prize or any component of a prize become unavailable. Except as specifically provided herein, all applicable taxes and usage charges on prizes are the sole responsibility of the winner. If required by law, Branch or its agents shall require payment from winner for taxes to be remitted to the appropriate taxing authorities. Branch expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of prizes awarded. Branch makes no representation or warranties concerning the appearance, safety or performance of any prize awarded.
CLAIMING PRIZES:
For the Holiday Haul Giveaway, the potential winner will be notified by a direct email from Branch on December 10, 2021. For the Bonus Holiday Contest, the potential winners will be notified by a direct email from Branch on December 23, 2021.
All potential winners have twenty-four (24) hours from the time the message is sent, to send a reply message to promos@branchapp.com. Potential winners may be asked to verify eligibility. Failure to respond within twenty-four (24) hours of potential winner notification may result in disqualification and alternate potential winners may be selected. If a potential winner is found to be ineligible; is not in compliance with these Official Rules; declines to accept the prize; does not comply with Branch’s instructions; or the prize is returned as undeliverable, the prize may be forfeited in Branch’s sole discretion. If a prize is forfeited, then the prize may be awarded to an alternate winner, selected in a random drawing from among all remaining eligible Entries received, as determined by Branch in its sole discretion. Branch shall not be held responsible for any delays in awarding the prize for any reason. Each prize will only be awarded to a verified winner. Any unclaimed prizes will be awarded in a random drawing to be held as necessary. Prize will be awarded once the potential winner responds to us with the email address associated with their Branch Account, or for AMOE Entrants, the email address to which the Amazon virtual gift card should be sent. By accepting a prize, each Entrant consents to Branch’s use of their name, photograph and/or likeness, address, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law. Upon deposit of the prize to the winner’s Branch Account or delivery of the prize to the AMOE Entrant’s email address, Branch will be deemed to have awarded the prize to the winner, with winner assuming full responsibility for the prize.
ADDITIONAL TERMS (applicable for all Entrants for both giveaways):
FRAUDULENT ENTRIES: Any Entry containing fraudulent activity, as determined by Branch in its sole and absolute discretion, will be considered ineligible and will not be part of the Sweepstakes. By submitting an Entry, each Entrant agrees his or her Entry complies with these Official Rules. Each Entrant also agrees that Branch may disqualify the Entrant from the Sweepstakes if Branch believes, in its sole and absolute discretion, that an Entry fails to comply with these Official Rules. If Branch rejects any Entry, such Entry will be disqualified and will not be considered a valid Entry. Entries may only be made according to the method described above. Automated entries (including but not limited to entries submitted using any robot, script, macro, or other automated service) are not permitted and will be disqualified. Only eligible Entries actually received by Branch before the end of the Sweepstakes Period will be included in the prize drawing. Illegible, unintelligible, incomplete, or garbled Entries will be disqualified.
PRIZE RESTRICTIONS: Prizes are not transferable. All taxes on the prizes are the sole responsibility of the prize winners. Prize winners are solely responsible for all other expenses not specified herein, including but not limited to applicable federal, state and local taxes and check cashing fees. Except where prohibited by law, prize winner’s entry and acceptance of a prize constitutes permission for the Sweepstakes Entities to use said prize winner’s name, photograph, likeness, statements, biographical information and voice on a worldwide basis, and in all forms of media, in perpetuity, without further compensation.Branch reserves the right to exclude entries from any Entrant or any potential prize winner who is suspected of theft, fraud, or any criminal activity related to Branch or its affiliates. Entries associated with fraudulent Branch Digital Wallets or other unauthorized use of Branch Digital Wallets and entries associated with any similar fraudulent or inappropriate activities relating to any such Branch Digital Wallets will be void and all such Entrants may be disqualified. Without limiting the foregoing, if an Entrant’s Branch Digital Wallet has been suspended or closed due to suspected fraud, he/she will not be eligible to win.
ALTERNATIVE METHOD OF ENTRY (AMOE): You may also enter the Sweepstakes by mail as follows. On a plain 3” x 5” index card, legibly handprint or type your first name, last name, complete address, email address, and selected non-profit organization and mail your completed 3” x 5” card to Branch: Branch 2021 Holiday Haul Sweepstakes, 8014 Olson Memorial Hwy 55, #471, Golden Valley, MN 55427. To be considered eligible in the Sweepstakes, AMOE entries must be postmarked no later than December 3, 2021. Each AMOE card received will be considered as one (1) Entry for that Entrant for the applicable Sweepstakes Period. Regardless of the method used to enter this Sweepstakes, the maximum number of entries allowed is one (1) per Entrant.
MISCELLANEOUS CONDITIONS: All entries become the property of Branch and will not be returned. By participating, Entrants agree to abide by and be bound by these Official Rules, which shall be final and binding with respect to all issues relating to this Sweepstakes. It is the Entrant’s responsibility to ensure compliance with all of the conditions contained in these Official Rules. Branch is not responsible for any lost, late, misdirected, stolen, illegible, incomplete Entries, or for any computer, online, telephone or technical malfunctions that may occur. Branch is not responsible for any incorrect or inaccurate information, whether caused by Website users, any of the equipment or programming associated with or utilized in the Sweepstakes, or any technical or human error which may occur in the processing of submissions in the Sweepstakes. Branch assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Branch is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. Branch is not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Branch which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Branch reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select winners from among all eligible entries received prior to the cancellation. Persons found tampering with or abusing any aspect of this Sweepstakes, or whom Branch believes to be causing malfunction, error, disruption or damage will be disqualified. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. NO LIABILITY: By entering, Entrants and each prize winner agree to comply with all Official Rules, as stated and agrees to release, discharge, indemnify and hold harmless Branch, its affiliates, retailers marketing/selling of the card, and their respective agents, representatives, officers, directors, shareholders, and employees, including the aforementioned releasees in the "ELIGIBILITY" section above from any claims, actions, injury, loss or damage of any kind, including, without limitation, personal injury or death, resulting, directly or indirectly, in whole or in part, from participating in this Sweepstakes or from the acceptance, possession, or use or misuse of any prize. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including, without limitation, compensatory, direct, indirect, or consequential damages; loss of data, income or profit; loss of or damage to property; and claims of third parties. Entrants agree that releasees have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express or implied, including, without limitation, the implied warranties of merchantability, title, and fitness for a particular purpose, in fact or in law, relative to this Sweepstakes.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Branch in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Minnesota, USA.
PRIVACY: By participating in this Sweepstakes, Each Entrant agrees to Branch’s use of their Entry for both online and offline direct marketing purposes. Entrants may review Branch’s Privacy policy at https://www.branchapp.com/privacy.
ARBITRATION AND CHOICE OF LAW: Except where prohibited by law, as a condition of participating in this Sweepstakes, Entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association (AAA) and held at the AAA regional office nearest the Entrant’s residence; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.
